Treść wiadomości: Water authority rejects mps claims, calls lawsuit 'patently false’ 'A state commission said Monday the Texas Department of Health and Human Services (DHHHS) was 'deliberately misleading the court’ about who owned the agency when it refused to provide records on how much mps received over the years and gave the public access to the records. That ruling was denied by the full Texas Court of Appeals Tuesday afternoon by Judge Royce Lamberth. 'This is a patently false lawsuit,’ said the Texas-based Public Policy Foundation’s Ben Ginsberg, who represented MPS on the case. 'The record shows it was not the agency who failed to collect the data the court ordered.’ The public had their wish, as a newly released Texas Department of Public Safety documents shows that agency provided records about the total amount of payments for various agency services to MPS for the period 1980 to 2011. MPS then used that information to claim it was not receiving mps funds from the state. 'The case is patently false,’ said Ginsberg. Texas has had problems with how to collect the money for various services, such as law enforcement, fire protection, and public health. But it is unclear why the agency wasn’t paid for each item before, when the court found it was. The lawsuit claims the state has withheld information from the court in order to 'protect the interests of the MPS’ and, therefore, to avoid possible liability in the future for the state of Texas for neglecting to collect certain information. This case has been filed by the public policy foundation to try and get this information released.
The public policy foundation, a group that advocates for transparency and government accountability, is a nonprofit organization.
The Texas Department of Public Safety (TDSS) is the state agency that controls access to public records and information about its agency’s activities.
But, the lawsuit asserts that the state’s claims of collecting mps funds, which the agency has denied for years, are simply lies.
DHS spokesman Joe Hoberg told the Dallas Morning News that he couldn’t comment on the current lawsuit.
'The information that was made public was based on some information received from the Texas Court of Appeals,’ he said.
However, Ginsberg told DailyMail.com on Monday that he expects the Texas Court of Appeals to throw out the lawsuit, writing, 'I think that means the case was dismissed.’
