Rfs legislation hampers aged care plans and makes it far harder for young people to access services

One of the UK’s most beloved organisations has been told it could face up to 14 months in jail if it fails to honour the commitment by the Care Quality Commission that it would conduct random checks on nursing homes over the next five years.

The regulator has ordered an investigation after evidence emerged that three nursing homes in a Kent village near Cambridge may not have been accredited as safe, even after a review led by Dr Michael McInnes, the commissioner for health and safety.

The inspection into Llanberis Nurseries, near Birstall, found that residents were being denied the necessary accreditation and needed to go to care homes where they could find the expertise to address their immediate needs.

„The commission has asked an investigation into the circumstances in Llanberis, and has asked for a report into whether there is reason to believe any changes to standards have been made, or should be made in the future,” the regulator said in a statement.

The health regulator made the findings in June this year after examining 1,020 nursing homes and eight nursing home trust branches in England, Wales and Northern Ireland.

Dr McInnes concluded that several nursing homes, including Llanberis, were failing to perform the basic requirements in order to be accredited, including ensuring that sick and injured patients received treatment as they need to and that elderly patients were given sufficient care.

Nursing homes are required to assess a range of standards on a case-by-case basis to ensure that they are able to provide the levels of treatment needed for residents’ needs, according to the Health and Safety Executive (HSE).

„The Llanberis Trust is taking this issue seriously, and we have put in place detailed and robust procedures to help address those issues,” a spokesman said. „A review and report is now due to take place following the results of the inspection and the review is expected by the end of February.”

Llanberis will face an investigation if it fails to conduct the checks by April 2018, as planned, or else faces a criminal prosecution by June 2018, according to the regulator. A charge of failing to perform a health inspection is the only action it can take, although it has previously used its powers to fine nursing homes for not meeting standard care.
